Confidentiality and supervision

The Legal Profession (Professional Conduct and Etiquette) Rules, 2020 (L.I. 2423) set out lawyers' duties of confidentiality, competence and supervision. AI use has to fit those duties: what may be entered into which tool, who checks the output, and who answers for it.

Client personal data

The Data Protection Act, 2012 (Act 843) governs how client personal data is collected, stored and shared, including with the software providers behind AI and automation tools.

Identity and source-of-funds checks on new matters, under the Anti-Money Laundering Act, 2020 (Act 1044) where it applies to the firm's work, suit a structured intake with a clear record of what was checked.

Partners who know how their associates are using AI.

Associates at a mid-sized law firm have begun using public AI tools to draft correspondence and summarise documents. The partners don't know which tools are in use or whether client information is being entered into them.

We would begin with a partners' session on what the tools can and can't be trusted to do, and agree rules on confidentiality and checking. Associates and support staff would then be trained separately, using the firm's own document types, on drafting, summarising and review with those rules built in. Repetitive tasks raised during the sessions would be listed for the partners to consider afterwards.

No new matter opens until conflicts and identity are checked.

At a corporate law firm, new instructions arrive by email and phone. Identity documents are photocopied, conflict checks rely on a partner's memory and an old spreadsheet, and work sometimes starts before either is complete.

A process review would map intake from first contact to engagement letter and agree who owns each check. The redesign would use one intake form, a searchable record of past parties for conflict checks and a simple rule that no matter opens until both checks are recorded.
